Can Illegal Citizen Sue for Child Custody?
An illegal citizen or illegal alien could sue another parent for child custody or child support. However this would be risky for that parent because going to court could mean deportation. No one asks if they are a citizen of the United States or not however going to court makes it difficult for this non-citizen to hide in the shadows as usual. Illegal immigrants do not like to go to court houses for any reason for fear of deportation. A court hearing over child custody rights does not necessarily mean deportation however you are exposing yourself to the possibility of deportation.

Children born in this country are automatically US citizens, however if their parents have not applied for citizenship then it’s possible that the child could remain in the USA while they are deported.
An illegal citizen could sue the other parent for custody or for child support.
